Statutory Rights
- If you are a consumer (ie a non-commercial customer) in the United Kingdom you have a statutory right as a consumer to cancel your contract with BlueSky Telemetry™ for any goods which you purchase from us over a distance (eg via this website, by telephone or fax) by notifying BlueSky Telemetry™ in writing that you wish to do so within 7 working days beginning with the day after the day when you receive the goods you ordered. Please note that if you decide to exercise your right of cancellation you must ensure that you take reasonable care of our goods and return them to us. BlueSky Telemetry™ will refund your money within 30 days of receiving a written notice from you that you wish to cancel your contract. If however you fail to return our goods, we may charge you for the cost of recovering our goods.
- Subject to the following provision, your statutory rights in the United Kingdom will not be affected by these terms and conditions: If you are a commercial customer of BlueSky Telemetry™, rather than a consumer, you hereby agree that Regulations 9(1), 9(2) and 11(1) of the Electronic Commerce (ED Directive) Regulations 2002 shall not apply to your dealings with BlueSky Telemetry™.
Your indemnity to BlueSky Telemetry
- You agree to keep BlueSky Telemetry™ indemnified against any claim, loss, liability, damages or expenses on a full and unqualified indemnity basis arising out of any misuse by you of any part of the website and any information embodied in it.
Governing Law
- These terms and conditions and all transactions conducted through this website are governed by the law of Scotland, and the Scottish Courts shall have non-exclusive jurisdiction in any disputes between us.
